Terms of Service

1. About us

  1. The Scar & Wonder website and online store is operated by Kizny Visuals & Consulting, Powstańców Śl 142/5, 5333 Wroclaw, Poland, with EU VAT number PL8971680361.
  2. The orders placed at our online store are operated by ZTB SC, Kolberga 3/100, 58506 Jelenia Góra, Poland, a civil partnership operating under Polish law, with EU VAT number: PL6110109698, acting as a seller.

2. Product Classification

  1. Our products are classified as Art Items, specifically unique wooden sculptures created and sold by the original artist, in accordance with Polish and EU legal regulations.
  2. Each item listed in our store is one-of-a-kind — you will receive the exact product pictured, with no substitutions or similar alternatives.

3. Pricing. Shipping costs and VAT

  1. All prices displayed in our store are net amounts and do not include VAT until the checkout page. The applicable VAT rate for art items sold by original creators is 8%, which is added during checkout. The final gross price including VAT will be shown before order confirmation.
  2. If you are purchasing as a consumer outside the EU or as a business within the EU with a valid registered VAT number, your purchase may be exempt from VAT upon verified proof. Please contact us before placing an order from outside the EU or to proceed with an intra-EU B2B transaction.
  3. We aim to ship most orders within 3-7 days; however, heavier items or unusual shipping destinations may require additional time to verify shipping methods and costs.
  4. Shipping rates are based on flat rates within Poland and the EU. For shipments outside the EU or exceptionally large items, we reserve the right to verify shipping costs after order placement and contact you if additional fees apply.
  5. Automated order confirmations are sent immediately after order placement. VAT invoices in digital format will be emailed within 7 days of payment clearance. Delays caused by payment processors (Stripe, Woo Payments, Apple Pay, Google Pay) may affect product and invoice delivery, and you will be notified accordingly.

4. Returns, refunds and “Cool-Off” Period

  1. Customers have the right to withdraw from their purchase within 14 days from the date of delivery, as per EU consumer law.
  2. To initiate a return, please contact us via cs@scarand…er.com within this period.
  3. Returned goods must be unused, in their original condition, and packaging, and shipped back to our address at the customer’s expense.
  4. Original shipping fees and return shipping costs are non-refundable.
  5. Please note that the right to withdraw may not apply to personalized or uniquely crafted bespoke items.
  6. Detailed return instructions will be provided upon request, and refunds will be processed promptly once goods are received and inspected.

5. Warranty

  1.  Our artisanal wooden goods are crafted from salvaged wood, which naturally carries character and uniqueness. These materials are not intended to be perfect; variations, natural imperfections, and signs of aging such as minor cracks or wood degradation are an inherent part of the product’s charm and are expected over time. Many items may already exhibit deliberate cracks when shipped, and further natural changes may occur, especially in pieces made from green wood. Please note, these natural characteristics and minor changes are not covered by the warranty.
  2. In the rare event of significant structural issues—such as the product breaking in half under normal use without accidental damage—please contact us. Since each piece is one-of-a-kind, we cannot replace the item with an identical one. However, we will explore options to offer you a comparable replacement, potentially with an upgrade, or we may propose repair solutions.
  3. This warranty supplements your statutory rights under applicable EU consumer protection laws, which provide a minimum two-year legal guarantee against defects present at delivery.

6. Privacy Policy, Jurisdiction, Additional Legal Information

  1. We comply with Polish and EU laws, including transparency in pricing, product descriptions, VAT, and returns.
  2. Personal data is processed solely to fulfill orders and in accordance with GDPR regulations. Our detailed data handling policies are available on the Privacy Policy page.
  3. These Terms and Conditions are governed by Polish law, with disputes subject to the jurisdiction of Polish courts. Customer service and all communications are conducted in English and Polish.
  4. We reserve the right to modify these Terms and Conditions, providing prior notice via our website or direct communication.

7. Limitation of Liability

  1. Our liability is limited to that allowed under EU consumer law and excludes indirect or consequential damages unrelated to product defects.
  2. Order Acceptance: Confirmation emails acknowledge receipt of an order but do not constitute a binding contract until payment is finalized.
  3. Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, or customs issues.
  4. Intellectual Property: All website content, images, text, and designs are protected and may not be used without explicit permission.

8. Prohibition on Automated Access and Data Use

This website is intended solely for use by human visitors to facilitate genuine human-to-human communication and the sale of artisanal objects. Use of any automated system, software, script, scraper, crawler, bot, or other means to access, extract, or collect data from this website is strictly prohibited.

 

Specifically, you are not permitted to:

  1. Perform any automated data scraping, harvesting, or extraction activities;
